( CENTRAL BORAD OF FILM CERTIFICATION) Registration - An Overview
Central Board of Film Certification (CBFC) , governmental controlling body for the Indian film making industry which is known as the Censor Board, and it was set up under the Cinematograph Act of 1952. The main objective of CBFC is to certify films, through screening and rating, short films, trailers, documentaries, and theatre-based advertisement of public view. The board issues certificates in four categories such as U, A,UA and S. It is mandatory for all films including foreign as well as Indian to have a CBFC certificate before the screening or broadcasting. CBFC is a body under the Ministry of Information and Broadcasting of Government of India.
THE CERTIFICATION OF FILMS PROCESS
The Cinematograph Rules spell out the steps a producer must take to have his or her film or feature film accredited, as well as the resources and fees that must be supplied.
- For certification of a film or short film, a formal application must be filed to the regional officer of the respective regional centre.
- After receiving all film related materials, written materials, and the prescribed fee, the regional office will assemble an examination committee. If the picture is short, the committee will be made up of a CBFC official and one panel member, one of whom must be a woman. Women must make up two out of every four members of the selection committee for feature films.
- After viewing the video, each member of the examining committee must submit a written report. This report includes changes, deletions, and the type of certificate that should be issued. The CBFC chairwoman will study the report and direct the regional officer to proceed with the next steps.
- The chairperson might send the film to the revising committee on his own or at the request of the film producer. A request for a revision committee must be made within 14 days following the board’s decision. The chairperson will be a member of the revising committee or will be represented in his absence by a member of the board and members of the CBFC or advisory panel. The members of the revising committee are not allowed to be same as examining committee.
- The revising committee will watch the film without making any modifications and provide written input. If the chairperson believes there is a lack of unanimity in the first revising committee’s feedback, he or she can call for another revising committee.
- The producer is informed of the revising/examining committee’s report, and he or she must make the necessary adjustments to the film as noted in the report and resubmit the updated version to the regional office.
- The producer is given the opportunity to express his or her opinions in front of the revising /examining committee before the censor board issues any certification to the picture.
- If the applicant disagrees with the board’s decision, he or she can appeal to the Film Certification Appellate Tribunal, which is chaired by a retired judge. Within 30 days of the board’s decision, the appeal must be filed. Before making a decision, the FCAT will hear from both the applicant and the CBFC.
